BACKGROUND AND ANALYSIS
The property of 1094 Oak Ridge Drive is currently under contract for purchase with intentions for redevelopment of the site including demolition of the existing single-family residence and construction of a new single-family residence. The property is currently comprised of two parcels, Lot 112 in Baird and Warner's Skokie Ridge Subdivision and the easterly 40 feet of Lot 3 in Raemer's Subdivision. Within a portion of Lot 3, there currently exists a 10-foot-wide public utility easement running north-south through the property, encroaching into the buildable area of the lot. The public utility easement was granted as part of the Raemer's Subdivision approval process in 1962. The Village has no utilities within the public utility easement area and, currently, has no plans for future utility installations within the easement area.
The contract purchaser of 1094 Oak Ridge Drive contacted the Village to request abrogation of the easement area. Although there are no Village-owned utilities within the property, staff requested a public utility easement be granted along the westerly 10 feet of the Lot 3 parcel to preserve a 10-foot-wide easement area within the property. The newly granted public utility easement would connect to an adjacent, existing public utility easement along the north property line.
